Książka jest próbą przeanalizowania i wyjaśnienia sporu, jaki toczy się współcześnie w polskiej literaturze przedmiotu, o rozumienie praw dziecka i ich ochronę w międzynarodowych dokumentach dotyczących praw człowieka oraz w praktyce społecznej. Rozprawa należy, jak zaznaczono w tytule, do dziedziny filozofii prawa, a więc przyjmuje filozoficzny punkt widzenia na toczący się spór. Dotyczy on zwłaszcza takich problemów, jak: podmiot i przedmiot praw dziecka, specyfika dóbr należnych dziecku z tytułu tych praw jako praw człowieka, specyfika samego dziecka jako bytu zależnego i środowisk, w jakich przebywa dziecko (rodzina, szkoła), a w których dokonuje się realizacja jego uprawnień. Ukazanie antropologicznych podstaw praw dziecka pozwala wskazać na źródła zróżnicowanych interpretacji tychże praw oraz sformułować propozycje dróg prowadzących do rozwiązania tytułowego sporu.
The book is an attempt to analyze and explain the dispute, which takes place today in Polish literature, about the understanding of children’s rights and their protection in international documents on human rights and in social practice. The monograph is, as it is in the title, to the field of philosophy of law, and therefore accepts a philosophical point of view to the ongoing dispute. It concerns especially problems such as: subject and object of the rights of the child, the specificity of goods due to the child in respect of these rights as human rights, the nature of the child as being dependent and the environments (family, school) in which the child is, and in which the fulfillment of the rights is done. Showing the anthropological bases of the children’s rights enables us to indicate the sources of different interpretations of these rights, and to formulate proposals for the ways leading to the solution of the title dispute.
